Mini-Session Photography Contract
It is mutually agreed that the following terms of agreement form an integral part of this Contract.
Pricing Payments: $150 session fee is required as deposit with this signed contract to secure booking. Fee is based upon a photographic session for up to five (5) people with an additional $35 charge for each person thereafter. In addition to the session, the Christmas Mini-Session Package includes: one unit/pose on 25 single cards with envelopes, up to two additional poses can be added to the card for an additional $50 each; one 8 x 10 desktop print; one 72 dpi watermarked, digital image for use with social media and email; and 10% off additional a la carte prints and products. Client agrees to pay remaining $50 balance upon receipt of package.
Cancellation/Rescheduling: If Client cancels within 30 or fewer days of the session the deposit is non-refundable. Photographic sessions are typically outdoors and the Photographer has the sole right to reschedule a session based upon weather interferences. Rescheduling at the request of the client may be subject to a 25% surcharge.
Session: The creation of images is at the sole artistic discretion of the Photographer. Client acknowledges that the photographer is a “photojournalistic” portrait photographer and adheres to said style. No shots throughout the session are guaranteed. Client acknowledges that the photographer is using her artistic discretion to create photographs as the photographer sees fit. Client understands that the mini-session is a 30 minute portrait session to include (1) unit/pose. Additional poses/units will be based upon time allowances and are at the sole discretion of the Photographer.
Images: Approximately 5-7 digital images will be processed and available for purchase. Preview images shall be posted online within two weeks (14 days) of session date.strong /strong Original images are maintained for 90 days.
Limitation of Liability: In the unlikely event that all of some of the photographs fail to materialize or there is total photographic failure due to reasons beyond Lisa Russell Photography’s control, the liability of Lisa Russell Photography will be limited to the refund of all money paid. Neither party shall be liable for indirect or consequential losses. In any event, the limit of Lisa Russell Photography’s liability shall not exceed the Package Price.
Copyright Release: The Client agrees that all images belong to Lisa Russell Photography and it is a criminal offense to copy or reproduce any of these forms or images by any means. Watermarked digital images may be duplicated and posted via email or social media with appropriate credit granted. Failure to correspond with Lisa Russell Photography will result in legal action. The Client hereby grants permission for all images to be displayed and used by Lisa Russell Photography for competition, advertising and Internet purposes. Lisa Russell Photography will endeavor to contact Client for these purposes when necessary.
